Waiver of Claims and Release of Liability: I hereby voluntarily waive, release, and forever discharge any and all claims, actions, causes of action, demands, rights, damages, losses, expenses, and compensation whatsoever whether known or unknown, foreseen or unforeseen, which I may now or hereafter have, claim to have, or assert against McKaig Nature Education Center, the Upper Merion Park & Historic Foundation, Old Roberts Schoolhouse (collectively, "McKaig"), its officials, directors, employees, representatives, volunteers, and any and all sponsors, including but not limited to Widgets Promotions, Upper Merion Area School District, Upper Merion Township, and their respective officials, directors, employees, representatives, volunteers, successors, and assigns (collectively, the "Released Parties"), for any injury, loss, damage, or liability of any kind that I may suffer or incur (including serious injury, disease, or death) as a result of or arising out of my presence on or visit to the Park and/or the Schoolhouse, regardless of whether such injury, loss, damage, or liability is caused by the negligence or other fault of the Released Parties.
Hold Harmless and Indemnification: I hereby agree to indemnify and hold the Released Parties harmless for any and all costs, expenses, demands, and damages of whatever nature (including attorney fees), arising from or concerning any claims or causes of action hereby released that are asserted against the Released Parties by me, members of my family, my employees, or by any person over whom I exercise authority, responsibility, or guardianship (including minors and incompetent persons). I hereby waive any and all defenses and immunities arising under common law or statute that would dilute or nullify my obligations under this agreement.
Assumption of Risk: I acknowledge that visiting the Park and/or the Schoolhouse involves inherent risks, dangers, and hazards. I attest that I am physically fit and sufficiently prepared for my visit. I knowingly and freely assume all risks associated with participating in any activities within the Park and/or the Schoolhouse, including, but not limited to: falls; contact with or conduct of other persons (including but not limited to communicable disease or illness, criminal, intentional, or negligent acts); the effects of weather conditions (including but not limited to flood, electrical storm/lightning, snow, ice, temperature, and humidity); fire and smoke; the condition of the trails, grounds, and buildings; falling objects (including but not limited to trees or branches); trip and/or slip hazards; wildlife (including but not limited to plants, fungi, pollen, animals, parasites, pathogens, and insects); dogs and pets; water hazards (including but not limited to drowning); and any other risks associated with being in a natural wooded environment and/or an historic building. I hereby acknowledge that I know and appreciate all such risks.
Image and Likeness Release: I hereby grant full permission to McKaig and its authorized representatives to photograph, videotape, and otherwise record my image, likeness, name, voice, and statements (collectively, "Images"). I further grant McKaig the irrevocable right and permission to use, reproduce, distribute, display, and create derivative works of these Images in any and all media, now known or hereafter devised, for legitimate accounts and promotional purposes related to the Park and/or the Schoolhouse, without any further consent from or payment to me.
Guided Hike and/or Event Safety Information - McKaig Nature Center Trails
Welcome to our guided hikes and/or events through the beautiful trails of McKaig Nature Center! We're excited to explore the natural wonders around us. However, for your safety and enjoyment, please be aware of the following potential hazards:
Uneven Terrain: Our trails are natural surfaces and contain roots and rocks. Please watch your footing carefully and wear appropriate closed-toe footwear with good ankle support.
Stream Crossings & Exploration: Our hike/event may involve crossing streams or exploring areas near the water. Stream beds can be slippery and water depths can vary. Please follow your guide's instructions carefully during any stream crossings or near-water activities. Do not enter the water without the explicit guidance and instruction of your hike leader.
Falling Branches: While we maintain our trails, there is always a risk of falling branches or trees, especially during windy conditions. Be aware of your surroundings.
Wildlife Encounters: McKaig is home to various insects and animals. Please be mindful of potential bites or stings. We strongly recommend using insect repellent to protect against mosquitoes and ticks.
Tick Awareness: Ticks are prevalent in this area and can transmit diseases. Please stay on marked trails, wear long pants tucked into socks, and check yourself thoroughly for ticks after the hike.
Poison Ivy: Poison ivy is common off the marked trails. Please stay on the designated paths to avoid contact. Learn to identify poison ivy (leaves of three, let it be!).
By participating in this guided hike or event, you acknowledge and understand these inherent risks. Your safety is our priority, so please follow your guide's instructions and exercise caution throughout the hike. If you have any concerns or medical conditions, please inform your guide before we begin.
By entering the Nature Education Center and/or the Schoolhouse, I acknowledge that I have read, understood, and voluntarily agree to all the terms and conditions of this Waiver and Release of Liability.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
